Confirmation votes are scheduled for tomorrow, June 11, 2012 in the US Senate. Obama’s nominee to the Ninth Circuit Court of Appeals is Andrew Hurwitz.

 

As a young law clerk, Andrew Hurwitz helped draft a lower court ruling that played a crucial influence in Justice Harry Blackmun’s infamous opinion in Roe v. Wade, the 5-4 decision that twisted the text of the Constitution into a right to abortion.

 

A growing number of lawyers, judges, and medical professionals (not to mention a majority of the American public) think the ruling is indefensible.   And while fewer stand by its flawed logic, Hurwitz has rushed to its defense, recently authoring a law review article celebrating the “careful and meticulous analysis” he helped craft in an opinion that has claimed the lives of tens of millions of unborn lives.

 

A nominee like Mr. Hurwitz, who played so notable a role in one of the most significant exercises of judicial activism in our nation’s history, must not be confirmed.
